CLAIM FORM IN THE PATENTS COUNTY COURT

 

 

1)      Claim Form (to be stamped with the fee and left at Court)

2)      Your copy of the Claim Form (to be stamped with the issuing office seal and kept by you as your original)

3)      An additional copy for each Defendant (to be stamped with the issuing office seal and taken away by you for service)

4)      An extra copy because you either will have under counted, or will convince yourself while sitting on the tube travelling to court that this is what you have done

5)      Issuing fee of £1,850[1] in the form of either:

a)      Cash; or

b)      Cheque made out to H.M.Courts Service

Credit cards, debit cards and Oyster cards are not accepted.

6)      Map showing the location of  Central London Civil Justice Centre, Park Crescent, London, W1N 4HT – you will need to go to number 13 – 14 to pay the fee and then take 1 – 5 above to number 26 to issue the Claim Form (in the Specialist Centre on the fourth floor)

7)      A large stamped envelope addressed to your favourite process server, if you plan to get the service copies to them as quickly as possible; in which event you must also include:

8)      A complete Response Pack for each Defendant plus the Particulars of Claim, if they are not incorporated in the Claim Form but are intended to be served with it.

9)      Phone number for the Clerk to His Honour Judge Fysh QC in the Patents County Court (Miss Kav Rekhi – 020 7073 4251) in order to tell her that the Claim Form has been issued.  (This is just a courtesy, but the transfer of documents from Park Crescent is not totally reliable and it is a sensible precaution to tell the court what is happening.  If the court wants a copy Miss Rekhi’s fax number is 020 7917 7935).


 

[1] This assumes that the claim is for an injunction plus damage enquiry/account of profits and must therefore be treated as one where the sum to be recovered is “unlimited”.  See Ryanlaw practice note at claim form fees
